Billion Law Successfully Defends Entrepreneur From Former Partner's Discharge Complaint

The Delaware Bankruptcy Court found in favor of Billion Law's client, an entrepreneur who had been by his former partner. The partner claimed that the debt at issue was non-dischargeable because it arose out of a settlement agreement that promised not to discharge the debt in future bankruptcy filings. The court granted Billion Law's Motion to Dismiss, emphasizing that promises not to seek discharge in bankruptcy, without additional evidence of fraud or false pretenses, do not meet the stringent requirements for nondischargeability under section 523(a)(2)(A).
